Losing Free Speech Essay - 1807 Words
ââ¬Å"I disapprove of what you say, but I will defend to the death your right to say it.â⬠These words were spoken by Franà §ois-Marie Arouet, more well known by his pen name, Voltaire (Quotes About Censorship, #36). A French philosopher from the seventeen hundreds, Voltaire is believed to have influenced the Founding Fathers of America. As a matter of fact, this quote makes up the backbone of the First Amendment from the U.S. Constitution, which states: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. While these wordsâ⬠¦show more contentâ⬠¦A small amount of censorship will not encroach on someoneââ¬â¢s freedom of speech, rather it will prevent America from falling into a hole of profanity and deprecation that she might never be able to dig her self out of. ââ¬Å"A journey of a thousand sites begins with a single click.â⬠The author of this quote is unknown, but they make a valid point. Any and all the information anyone could ever want is available to anyone and everyone who wants it. The Internet has absolutely no limits because itââ¬â¢s infinite; no one can control it. Thereââ¬â¢s no way. Itââ¬â¢s because of this fact that there are sites like WikiLeaks popping up, snubbing their noses at the government knowing that there is nothing to be done to stop them. However, itââ¬â¢s also because of WikiLeaks that the government and other private sources have started to step in and moderate what should be considered appropriate. Take, for example, the school board in Cohasset, Massachusetts. Dr. June Talvite-Siple was caught by parents making derogatory remarks about her students and the school district on her Facebook page, resulting in her firing. While itââ¬â¢s easy for Dr. Siple to argue that she believe d her privacy settings were set in such a way that no one but her friends would be able to see her posts, the issue still stands. She was criticizing her place of work on the Internet, a place where anyone can find information about anything. Exploring Traumatic Brain Injury in Children Essay
Traumatic brain injury (TBI) is a leading cause of death and disability among children and adolescents (Yeates, 2005). The Center for Disease and Control (2010) reported an estimated 1.7 million individuals sustaining TBI annually with 51% of these injuries occurring during periods of cerebral development. Children (0-4 years), older adolescents (15-19 years) and older adults (65+ years) are most likely to sustain TBI (CDC, 2010). Brain injuries often lead to severe, pervasive, and potentially irreversible impairments in oneââ¬â¢s neurological, cognitive, emotional, and social functioning (e.g., Wilde et al, 2012; Yeates, 2005). This analysis will examine the etiology, prevalence, and impact of traumatic brain injury in the developing brain ofâ⬠¦show more contentâ⬠¦Neuroimaging scans play a cardinal role in TBI diagnosis, prognosis, and deciding what treatments to give. CT is the preferred method of assessment on admission to determine structural damage and to detect (deve loping) intracranial hematomas (Maas, Stocchetti, Bullock, 2008). The preferred test is the computed tomography (CT) scan due to its speed, accuracy, and accessibility. The magnetic resonance imaging (MRI) exhibits more details than CT scan. MRI scan can be more advantageous than the CT scan as it is able to detect other TBI symptoms such as diffuse axonal injury (DAI). Conversely, MRI is usually not the preferred method in emergency setting due to its inability to detect brain hemorrhage and fractures, general inaccessibility, and lengthiness of the procedure. Childhood TBI Previous studies expressed concern in childrenââ¬â¢s TBI acquisition in their developing brain. Wilde et al (2012) explains that ââ¬Å"the neurocognitive and neurobehavioral morbidity is particularly significant with acquired child brain injury because the injury disrupts the neural maturation and developmentâ⬠(Catroppa et al., 2008). Researchers hypothesized that childhood TBI potentially disrupt the development of certain brain regions through pathological changes. Risk Management free essay sample
Enterprise Risk Management is defined as ââ¬Å"the process of identifying and analyzing risk from an integrated, company-wide perspective. It is a structured and disciplined approach in aligning strategy, processes, people, technology and knowledge with a purpose of evaluating and managing the uncertainties the enterprise faces as it creates valueâ⬠(Woon, Azizan, Samad,à 2011, p. 23). Had Non-Linear Pro utilized Enterprise Risk Management, the company would have been able to reduce their liability exposure. Quick Takes Video is in the position of having a legitimate claim against Non-Linear Pro for breach of warranty. The salesman informed Hal that his employees would be able to operate the software in one to two days. After two weeks of attempting to utilize Non-Linear Proââ¬â¢s product, Halââ¬â¢s employees have come to the conclusion that the product cannot perform as promised. They state that the program has insufficient memory, and can only edit 5 minutes of high definition video at a time. We will write a custom essay sample on Risk Management or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page Additionally, it does not appear that the difficulties with Non-Linear Pro are simply the result of the limits of available technology. Halââ¬â¢s employees mention a competing program used by other companies which appears to far outperform Non-Linear Pro. This further strengthens Quick Takesââ¬â¢ potential claim for breach of warranty. Although it is reasonable that there will be differences between competitorsââ¬â¢ products such as features and the abilities of software, it is also reasonable to assume that the product will be able to perform the necessary functions it was designed for, in this case, editing video. The 7 steps of Enterprise Risk Management are: 1) Management commitment ) Communication and consultation 3) Policies and procedures 4) Training and education 5) Effective and efficient framework 6) Risk Management is applied in practice 7) Ongoing monitoring and review (Harb, 2008) Management Commitment: If Non-Linear Pro is going to embrace Enterprise Risk Management (ERM), all employees need to be on board with the program, starting with senior management. If the firm is simply looking to go th rough the motions and is not willing to ingrain risk management into the corporationââ¬â¢s culture, employees will quickly see through the ruse. For a program such as this to be successful, all employees need to understand how ERM will benefit the company. Communication and Consultation Non-Linear Pro should have provided Quick Takes Video a more realistic expectation of their productââ¬â¢s abilities and limitations. Halââ¬â¢s employees mention a competing product that performs better, but it also seems to be more expensive. It is reasonable to expect a lower priced product to perform at a lesser level than its more expensive counterpart. The problem arose when Non-Linear Proââ¬â¢s sales person oversold his product and made promises his product could not deliver. Also during the video, Non-Linear Proââ¬â¢s salesman does not appear to have been involved after the sale. The items were delivered, and Quick Takes Videoââ¬â¢s employees were utilizing the manual and their prior knowledge of editing software to learn the new product. Had Non-Linear Proââ¬â¢s salesman embraced ERM and viewed his role as more of a sales consultant, rather than a sales person, he would have executed the proper follow up and assisted Quick Takes Videoââ¬â¢s employees with the learning curve inherent in utilizing any new product. By providing training after the sale, Non-Linear Proââ¬â¢s salesman may have been able to avoid some of the problems that arose in the video. Policies and Procedures: Non-Linear Proââ¬â¢s greatest risks in their situation with Quick Takes Video are tort liability for breach of warranty, strict liability for Janetââ¬â¢s cut and subsequent infection, litigation costs if the dispute is not resolved, and the potential costs of negative publicity to future sales. In addition to these potential consequences, Non-Linear Pro also faces the possibility of losing the sale of the product to Quick Takes Video, as well as any future sales that may have been generated through repeat business. The key elements of ERM are the policy itself, the strategy, and the plan (Harb, 2008). If Non-Linear Pro had embraced and implemented a successful ERM plan, many of these negative consequences could have been avoided. Effective and Efficient Framework Harb suggests that firms have a well documented ERM policy and plan (2008). Had Non-Linear Pro had such a policy and plan in place, they would have been able to anticipate many of the problems Quick Takes Video is encountering with the editing software and addressed these difficulties before they became full size problems. A well laid ERM plan would have involved on-site set up and training for Quick Takes Videoââ¬â¢s staff, along with follow up to ensure everything was working smoothly and as expected. Risk Management is Applied in Practice Non-Linear Pro needs to not only assess their possible risks, but also apply this assessment in practice. The salesman is directly responsible for over promising and under delivering on this editing software, therefore creating a possible breach of warranty. It is more likely that he is a poor salesman, as opposed to having acted with negligence or malicious intent, so any attempt to hold him personally responsible would likely fail. But as he was acting in the course of his employ with Non-Linear Pro, and was Quick Takes Videoââ¬â¢s direct contact person with the company, the errors of the salesman belong to Non-Linear Pro, and the company as a whole is ultimately responsible for the breach of warranty. Ongoing Monitoring and Review ERM is a ââ¬Å"regular process and not just a one-time eventâ⬠(Harb, 2008). Were Non-Linear Pro to make ERM an integral part of their business, it would require a top down commitment. Management has to be willing to expend the resources in both time and money to properly train employees and ensure the companyââ¬â¢s products are capable of performing as intended. Employees also need to be an active part of ERM, as only with their commitment can the companyââ¬â¢s goals be achieved while also minimizing risk. Non-Linear Proââ¬â¢s overall approach to their sale to Quick Takes Video was the source of the many difficulties that followed. The lack of training and follow up has led to problems with the product while the poor communication has led to a combative relationship between the companies.
